Procedures of Work of IPR SAC

 

GA

  • Resolves to develop a new Technical Specification (TS),

  • Communicates its decision to the Board of Directors (BD) with

    • Terms of Reference of Development Committee (DC) to be established

    • Requirements of the TS.

BD

Establishes DC

Appoints DC chair

Sends TS Requirements to IPR SAC requesting the development of a Framework Licence (FWL) within a deadline.

Sec

Identifies the Principal Members who intend to participate in the development of the TS

IPR SAC

  • Establishes a group whose members belong to Principal Members who intend to participate in the development of the TS (“active members”)

  • Requests the BD to appoint a chair for the said group

  • Requests active members to submit proposals of FWLs

  • Requests the services of IPR experts, with the agreement of the IPR SAC chair, if necessary

  • Approves the FWL by 2/3 majority votes of active members present

  • Transmits the FWL to the BD

Reviews, approves and communicates FWL to GA

 

Procedures of Work of Development Committees

 

GA

  • Establishes and maintains the Work Plan (WP) that describes the ongoing and planned work leading to Technical Specifications (TS)

  • Any Member may submit contributions to WP

  • Issues Calls for Interest (CfI) to sense the needs of industry for TS

  • Any company, organisation or individual, irrespective of its membership in MPAI, is entitled to submit a written contribution in response to the CfI ·  

  • When the need for a TS is identified

    • Asks the Requirements Standing Committee (Reqs) to develop requirements and a possible timeline for the development for the planned TS

    • Adds the relevant information to the WP

    • Approves the WP

Reqs

  • Develops requirements

  • If there is no consensus that technology with the expected levels of performance exists, issues a Call for Evidence (CfE)

  • If the evidence collected from the CfE is positive or if there is consensus that technology exists, communicates requirements to GA

GA

  • Develops the Terms of Reference (ToR) of the DC tasked to develop the TS

  • Sends ToR of DC and TS Requirements to BD

BD

  • Sends TS Requirements to IPR SAC

IPR SAC

  • Develops and sends Framework Licence (FWL) to BD

BD

  • Reviews and approves FWL

  • Establishes DC

  • Appoints DC chair

  • Sends relevant information to GA

GA

  • Calls Principal and Associate Members to provide the necessary expertise for the DC to accomplish its mandate

  • Asks Reqs to develop a Call for Technology (CfT) whose goal is to obtain the technologies required to develop the TS

  • Kicks off DC activities

Req

  • Develops CfT jointly with DC

  • Asks GA to issue CfT

  • Any company, organisation or individual, irrespective of its membership in MPAI, is entitled to submit a written contribution in response to the CfT.

  • Responses to the CfT shall comply with the submission deadlines established by the GA and contain a declaration that the Member will license its essential patents to the TS and take a licence for the essential patents to the TS held by other members, if used

  • Assesses responses to CfT jointly with DC

DC

  • If (a part of) a submission from a non-participant, is identified for inclusion in a specification, the originator will be requested to immediately join MPAI. 

  • If such non-participant elects not to join MPAI, their submission will be discarded.

  • Each active member submitting a technical document related to the TS shall declare that it shall

    • License any of its essential patents to the TS in accordance with the FWL

    • Take a licence for the essential patents to the TS held by other members, if used.

  • Each Member shall inform the Secretariat of the result of its best effort identification of IP that it believes is infringed by a TS being or already developed by a DC.

  • DC experts contribute to the progress of the TS by making consensus-based decisions.

  • The chair is tasked to detect that consensus is reached on a given issue.

  • If consensus is not reached on a given issue, the matter is brought to the attention of the GA who decides by 2/3 majority vote.

  • At each stage of development of a document relating to the TS, may identify areas on which participants are requested to submit contributions.

  • Submissions on other topics will be considered at the discretion of the DC Chair in consultation with the author of the submission and the members of the DC and will be referred to the GA.

  • During the development of the TS, the need for additional technologies may be identified. These may be obtained through new CfTs, possibly restricted to MPAI members.

  • The TS will evolve through a series of drafts. When a draft has achieved sufficient maturity and is supported by DC member consensus it is transmitted to GA
